Copyright Protection

Q.  What does it mean to be copyright protected?

A.  According to the US Copyright Office, copyright is a form of protection grounded in the U.S. Constitution and granted by law for original works of authorship fixed in a tangible medium of expression. Copyright covers both published and unpublished works.  Copyright, a form of intellectual property law, protects original works of authorship including literary, dramatic, musical, and artistic works, such as poetry, novels, movies, songs, computer software, and architecture.  Copyright does not protect facts, ideas, systems, or methods of operation, although it may protect the way these things are expressed.

Q.  How does Twinkle Twinkle Little Books ensure that my child’s work is copyright protected?

A.  The 1976 Copyright Act automatically extends to full term (section 304 sets the term) copyright for all works, including those subject to ad interim copyright if ad interim registration has been made on or before June 30, 1978.

Based on this, no publication or registration or other action in the Copyright Office is required to secure copyright. This is secured by the 1976 Copyright Act  which automatically extends copyright to full term, without the need for registration.  There are, however, certain definite advantages to registration but it does require a fee.

We, at Twinkle Twinkle Little Books and Twinkle Twinkle Little Writer’s Club secure copyright for your child’s work in two ways – through publication and through declaration.  We do not register work that is “soft” published on the website.  Work that is deemed publishable for hard cover books will be registered as part of the contract.

Your child’s work is protected through all of these provisions.

Q. How can I go about registering my child’s work outside of Twinkle Twinkle Little Books?
